By accessing or using ForwardPlanAI ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

ForwardPlanAI is a software-as-a-service platform that provides social media campaign planning, content generation, and scheduling tools. The Service uses artificial intelligence to assist with campaign strategy and content creation.

3. User Accounts and Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring you have the right to use any content you upload
  • Complying with all applicable laws and regulations

4. Subscription and Billing

Subscription plans are billed monthly or annually in advance. You may:

  • Upgrade or downgrade your plan at any time
  • Cancel your subscription at any time from your account settings
  • Receive a prorated refund for the unused portion if downgrading

Refunds are not provided for partial billing periods after cancellation. All fees are non-refundable except as required by law.

5. Content and Intellectual Property

You retain ownership of all content you upload to the Service. By using the Service, you grant ForwardPlanAI a limited license to:

  • Store, process, and analyze your content to provide the Service
  • Use AI models to generate content based on your inputs
  • Display your content within the Service interface

You warrant that you have all necessary rights to any content you upload and that it does not infringe on any third-party rights.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload content that is defamatory, obscene, or violates privacy rights
  • Attempt to reverse engineer, decompile, or extract source code from the Service
  • Use automated systems to access the Service in a manner that exceeds reasonable usage
  • Share your account credentials with others

7. Service Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

8. AI-Generated Content

Content generated by our AI tools is provided "as is" and may require review and editing. You are responsible for reviewing all AI-generated content before use. ForwardPlanAI does not guarantee the accuracy, appropriateness, or compliance of AI-generated content with your specific requirements or applicable laws.

9. Data Retention and Deletion

Upon cancellation, your data will be retained for 30 days to allow for account reactivation. After this period, data may be permanently deleted. You may request immediate deletion of your data by contacting us. Our data handling practices are detailed in our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, ForwardPlanAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless ForwardPlanAI from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service interface. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease.

14. Governing Law

These Terms are governed by the laws of Australia. Any disputes will be resolved in the courts of Australia.
